1. Service Description

TenderX is a Software-as-a-Service (SaaS) platform that provides AI-powered analysis of procurement and tender documents. Our service includes:

  • • Document upload and processing
  • • AI-powered content analysis
  • • Key information extraction
  • • Professional report generation
  • • Export to PDF and PowerPoint formats
  • • Usage analytics and tracking
  • • Account management and settings
  • • Customer support services
2. User Accounts and Registration

Account Requirements

  • • You must be at least 18 years old or have legal capacity to enter contracts
  • • Provide accurate and complete registration information
  • • Maintain the security and confidentiality of your account credentials
  • • Accept responsibility for all activities under your account

Account Security

  • • Use a strong, unique password for your account
  • • Notify us immediately of any unauthorized access
  • • Do not share your account credentials with others
  • • Log out of shared or public computers
3. Acceptable Use Policy

You May:

  • • Upload legitimate business and procurement documents
  • • Use AI analysis results for business decision-making
  • • Export and share reports as needed for business purposes
  • • Access your account from multiple devices

You May Not:

  • • Upload illegal, copyrighted, or confidential content without authorization
  • • Attempt to reverse engineer, hack, or compromise our systems
  • • Use the service for any unlawful or harmful activities
  • • Share or resell access to your account
  • • Upload malware, viruses, or other harmful content
  • • Exceed reasonable usage limits or abuse system resources
4. Subscription and Billing

Subscription Tiers

We offer different subscription tiers with varying features and usage limits:

  • Free: Limited document analysis with basic features
  • Pro: Increased limits and advanced analysis features
  • Enterprise: Unlimited usage with priority support

Billing Terms

  • • Subscriptions are billed monthly or annually in advance
  • • All fees are non-refundable except as required by law
  • • Price changes will be communicated 30 days in advance
  • • Failed payments may result in service suspension
  • • You can cancel your subscription at any time

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You'll retain access to your data and can reactivate your subscription.

5. Data Ownership and Privacy

Your Data Rights

  • • You retain ownership of all documents and content you upload
  • • We process your data only as necessary to provide our services
  • • You can export or delete your data at any time
  • • We comply with GDPR and other applicable privacy laws

Data Usage

  • • We use your documents solely to provide AI analysis services
  • • Your content is not used to train AI models or shared with third parties
  • • We may use anonymized usage data to improve our services
  • • All data is encrypted in transit and at rest

6. Service Availability and Support

  • • We aim for 99.9% uptime but do not guarantee uninterrupted service
  • • Scheduled maintenance will be announced in advance when possible
  • • Emergency maintenance may occur without prior notice
  • • We're not liable for service interruptions beyond our control

  • • Email support is available for all users
  • • Response times vary by subscription tier
  • • We provide support in English, German, and French
  • • Support hours: Monday-Friday, 9 AM - 6 PM CET
7. Limitations of Liability

Service Limitations

  • • AI analysis results are provided "as is" and may contain errors
  • • You should verify AI-generated insights independently
  • • We're not responsible for business decisions based on our analysis
  • • The service is not a substitute for professional legal or business advice

Liability Cap

Our total liability to you for any claim arising from or related to these terms or your use of our service is limited to the amount you paid us in the 12 months preceding the claim, up to a maximum of €1,000.

Excluded Damages

We're not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if we've been advised of the possibility of such damages.

8. Termination

Termination by You

  • • You may terminate your account at any time
  • • Download your data before termination - we'll delete it after 30 days
  • • Paid subscriptions continue until the end of the billing period

Termination by Us

  • • We may suspend or terminate accounts for terms violations
  • • 30 days notice for termination without cause (except free accounts)
  • • Immediate termination for illegal activities or security threats
  • • You'll have 30 days to export your data after termination notice
9. Legal and Governing Law

Governing Law

These terms are governed by the laws of Ireland. Any disputes will be resolved in the courts of Dublin, Ireland, unless you're a consumer with mandatory local consumer protection laws.

Dispute Resolution

  • • We prefer to resolve disputes informally - contact us first
  • • EU consumers may use the EU Online Dispute Resolution platform
  • • These terms don't limit your statutory consumer rights

Changes to Terms

We may update these terms to reflect changes in our service or legal requirements. We'll notify you of material changes via email or service notification. Continued use after changes constitutes acceptance.
